The establishment
of the ACDPU is prescribed in Article 92 of the Constitution
and its organization, function and other necessary matters
are determined by the Law of the Advisory Council on Unification.
The Constitution states that the ACDPU was mandated
in order to respond to the President's need for consultation
on formulating and implementing peaceful unification
policy. The ACPDU's major functions are defined by the
ACDPU Law.
According to Article 92 of the Constitution, the ACDPU
may be established to advise the President on the formation
of peaceful unification policy, (Clause 1), and the organization,
functions and other necessary matters pertaining to the
ACDPU shall be determined by the law. (Clause 2)
Article 2 of the Revised ACDPU Law (effective on July
24, 2001) prescribes that the ACDPU should carry out
the activities necessary for determining national consensus
on democratic and peaceful unification, integrating
the pan-national will and capacity for unification,
and making recommendations and providing consultation
to the President on formulating and implementing a democratic
and peaceful unification policy.
The ACDPU is endowed with 4 major
functions: Collecting various opinions among Koreans worldwide,
Confirming the national consensus on unification, Integrating
the pan-national will for unification and carrying out
all other matters necessary for advising and making recommendations
on the presidential unification policy.
The first function of the Revised ACDPU law is collecting
various opinions among Koreans worldwide and carrying
out public relations on unification policy. In order to
effectively formulate and implement the democratic and
peaceful unification of our homeland, it is necessary
for the ACDPU's Consulting Councils established both domestic
and abroad to collect various opinions and carry out public
relation on unification policy.
The second function defined by the ACDPU law is deriving
a national consensus on peaceful unification. Through
the promotion of North Korean policy based on a national
consensus , ACDPU can implement the principle of democratic
and peaceful unification and carry out various activities
to form and maintain a national consensus that can secure
pan-nation participation in the unification process.
The third function prescribed by the ACDPU law is the
integration of pan-national will and capacity for unification.
The terms of pan-national means collectiong all opinions
from every sector of society and reflecting these opinions
in the formulation of including Korean society abroad
unification policy.
The last function defined by ACDPU law is to recommend
and advise the president in relation to the formulation
and inplementation of a unification policy based on the
principles of democracy and peace.
The law, in short, provides the ACDPU with intermediating
between the nation and the President by representing the
public opinion and advising the president on a unification
policy.
